Property Litigation; Tomlin Order

Acting for a private individual (claimant) in a dispute with a co-leaseholder (defendant).  The claimant sought an order for sale made under section 14 of the Trusts of Land and Appointment of Trustees Act 1996.  The parties settled the case by way of a Tomlin Order.  There is now a disagreement in respect of the construction of the Tomlin Order and both sides have made corresponding applications in the County Court at Central London for specific performance of the terms of the Tomlin Order.  The case continues.
