Commercial Litigation: Breach of Contract Claim
Acting for a wealthy private individual in respect of a breach of contract claim. The client was unable to attend trial due to ill-health and judgment was awarded in favour of the claimants. The case involved a consideration of the rare provisions under CPR 39.3 (https://www.justice.gov.uk/courts/procedure-rules/civil/rules/part39) relating to the court's power to restore the proceedings for the purposes of a re-trial. Further, the case involved obtaining a retrospective capacity assessment in order to challenge the making of a final charging order and to have the judgment set aside.
